Terms of Service

1. Eligibility

You must be at least 13 years old to use the Services, and old enough to form a binding contract in your jurisdiction. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or guardian. By using the Services, you represent that you meet these requirements.

2. The Services

DEEPR lets you record short voice samples, receive an analysis of characteristics such as depth, confidence, clarity, engagement, and fluency, and complete guided exercises intended to help you train how you sound. Scores and measurements are estimates provided for informational and self-improvement purposes only.

We may add, change, suspend, or remove features of the Services at any time. We may also impose limits on certain features, such as limiting the number of voice recordings you can submit within a given period.

3. Your Account

You are responsible for the information you provide, for maintaining the security of your account and device, and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use. We are not liable for any loss arising from your failure to safeguard your account.

4. Subscriptions, Billing & Cancellation

Some features require a paid subscription. Subscriptions are sold and billed through the Apple App Store, and payment is charged to your Apple Account. Prices are shown in the app before purchase.

• Auto-renewal: Subscriptions automatically renew for the same period unless auto-renew is turned off at least 24 hours before the end of the current period.
• Managing your subscription: You can view, change, or cancel your subscription at any time in your Apple Account settings. Cancellation takes effect at the end of the current billing period.
• Refunds: Purchases are handled by Apple, and refund requests are subject to Apple's policies. We do not process payments or issue refunds directly.
• Other access: Where offered, we may grant access through non-paid means (such as referral rewards). Any such access is provided at our discretion and may change.

Your purchase is also subject to Apple's applicable terms, including the standard Licensed Application End User License Agreement.

5. Health & Wellness Disclaimer

DEEPR is a wellness and self-improvement tool. It is not a medical device and does not provide medical, diagnostic, or therapeutic advice. The Services are not a substitute for professional evaluation or treatment of any voice, speech, hearing, or health condition. If you experience pain, strain, or any concern about your voice or health, stop and consult a qualified professional. You use voice exercises at your own risk.

6. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms;
• Submit recordings of anyone who has not consented, or content that infringes the rights of others;
• Reverse engineer, decompile, copy, or attempt to extract the source code of the Services, except where permitted by law;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems; or
• Use automated means to access the Services in a way that burdens our infrastructure.

7. Your Content & Voice Recordings

You retain ownership of the voice recordings and other content you submit. You grant us a limited license to process that content solely to operate and improve the Services, as described in our Privacy Policy. You are responsible for ensuring you have the right to submit any content you provide.

8. Intellectual Property

The Services, including the app, its content, design, and trademarks, are owned by Biga Studio or our licensors and are protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Services for your own non-commercial use, subject to these Terms. All rights not expressly granted are reserved.

9. Third-Party Services

The Services rely on and may link to third parties, such as the Apple App Store. We are not responsible for third-party services, terms, or content, and your use of them is governed by their own agreements.

10. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any score, measurement, or result will be accurate or produce any particular outcome.

11. Limitation of Liability

To the maximum extent permitted by law, Biga Studio and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Biga Studio from any claims, damages, liabilities, and expenses arising out of your misuse of the Services or your violation of these Terms or of any law or the rights of a third party.

13. Termination

You may stop using the Services at any time and delete your account through the app. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services. Provisions that by their nature should survive termination, including sections on intellectual property, disclaimers, limitation of liability, and indemnification, will survive.

14. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by an updated "Last updated" date. Material changes will take effect when posted, and your continued use of the Services after they take effect means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws applicable at Biga Studio's principal place of business, without regard to conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the courts located there, unless applicable law requires otherwise.
